Copyright & DMCA Policy

SmokiesApp respects the intellectual property rights of others and expects users of the Services to do the same. This Policy explains how to report alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).

1. Reporting Copyright Infringement

If you believe content on the Services infringes your copyright, send a written notice to our Designated Copyright Agent including:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material with enough detail for us to locate it.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner.

3. Counter-Notification

If you believe material was removed by mistake or misidentification, you may submit a counter-notification including:

  • Your physical or electronic signature.
  • Identification of the removed material and where it appeared.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed because of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • Your consent to the jurisdiction of the appropriate federal court and agreement to accept service of process from the original claimant.

4. Repeat Infringers

SmokiesApp may remove infringing material and, where appropriate, suspend or terminate accounts of users who repeatedly infringe the intellectual property rights of others.

5. Misrepresentations

Knowingly submitting a false DMCA notice or counter-notice may result in legal liability under applicable law.

6. Changes

We may update this Policy from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Policy.
